PHEASANT NATION STORE TERMS OF SERVICE

Effective date: October 15, 2026

These Store Terms of Service (the "Store Terms") apply when you buy from the Pheasant Nation store, operated by Pheasant Nation LLC, 2028 23 RD, Kearney, NE 68845 ("Pheasant Nation," "we"). Our Refund Policy, Shipping Policy, Subscription Policy and Privacy Policy are part of these Store Terms. If you buy a membership, the Membership Terms of Service at pheasantnation.com/membership-terms also apply, and they control for anything about memberships. Giveaways and contests are governed by their Official Rules at pheasantnation.com/official-rules.

1. ORDERS AND PRICING
- All prices are in U.S. dollars. Taxes and shipping are added at checkout.
- Your order is an offer to buy. We may refuse or cancel any order, including if an item is out of stock, is listed at the wrong price, or we suspect fraud or resale. If we cancel, we'll refund anything you paid.
- Quantity limits may apply to some products and promotions.

2. PRODUCT INFORMATION
We work to describe and photograph products accurately, but colors, sizing and details may look different on your screen or vary slightly between production runs. Check the size chart before ordering.

3. DISCOUNTS AND MEMBER PRICING
The member discount applies to eligible merchandise while your membership is active, as described in the Membership Terms. Discount codes have no cash value, can't be combined unless stated, and may end at any time. Misused codes may be cancelled.

4. CONSERVATION & BANDED BIRD FUND
Contributions to the Conservation & Banded Bird Fund are paid to Pheasant Nation LLC, a for-profit company. They are not charitable donations, are not tax-deductible, and are non-refundable except where a refund is required by law. They support the Banded Bird Project, pheasant releases and habitat work, and may earn giveaway entries as described in the Official Rules.

5. USING OUR PRODUCTS SAFELY
- Use products only as intended and follow all labels, instructions, sizing and care directions.
- Apparel and accessories, including blaze-orange items, are not personal protective or safety equipment unless the product label says so. They do not replace hunting laws, hunter-education rules or safe firearms handling.
- Supervise children with any product, and keep small parts away from young children.

6. WARRANTIES
EXCEPT AS STATED IN OUR REFUND POLICY, AND TO THE FULLEST EXTENT PERMITTED BY LAW, PRODUCTS ARE SOLD "AS IS" WITHOUT ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. PRODUCTS MADE BY OTHER BRANDS ARE COVERED ONLY BY THEIR MANUFACTURER'S WARRANTY, IF ANY. SOME STATES DO NOT ALLOW THESE EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU, AND YOU MAY HAVE OTHER RIGHTS UNDER STATE LAW.

7. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, PHEASANT NATION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING FROM ANY PRODUCT OR PURCHASE, AND OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE PRICE YOU PAID FOR IT. NOTHING IN THESE STORE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING FOR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE WHERE THE LAW DOES NOT ALLOW IT.

8. PRE-ORDERS
Pre-order items are charged at checkout. Ship dates are estimates; if a date changes we'll let you know, and you can cancel for a full refund any time before the item ships.

9. OUR CONTENT AND TRADEMARKS
The Pheasant Nation name, logos, artwork and product designs belong to Pheasant Nation. You may not copy, resell or use them commercially without our written permission.

10. GOVERNING LAW AND DISPUTES
These Store Terms are governed by the laws of the State of Nebraska. Please contact us at support@pheasantnation.com or 308-223-3411 first so we can try to resolve any problem within 30 days. Except where prohibited, disputes will be resolved individually, not as part of a class or representative action, in the state or federal courts located in Buffalo County, Nebraska. Either party may bring an individual claim in small claims court where eligible.

11. CHANGES
We may update these Store Terms by posting a new version with a new effective date. The version posted when you place an order applies to that order.
